This document sets out the legal conditions governing access, registration, participation, the processing of personal data and the use of services offered by Social Meta World, hereinafter “SMW” or “the Platform”.
SMW is a collaborative digital platform for sharing, classifying, studying and verifying geographical knowledge, particularly knowledge used to recognise places and features of the environment in geolocation games such as GeoGuessr.
This document is divided into independent sections accessible from a single page, to provide clear and transparent information.
LEGAL NOTICE
### 1.1. Identification of the owner
In accordance with Spanish legislation on information society services, the person responsible for and owner of SMW is Nebek Yamil Adur Salas, with NIF 51402098L and established in Málaga, Spain.
Address to be completed before final publication: [OWNER’S LEGAL ADDRESS].
For any communication, enquiry or complaint relating to the Platform, users may write to socialmetaworld@gmail.com.
1.2. Purpose of the Platform
SMW aims to facilitate the creation and consultation of a community library of geographical knowledge through metas, guides, maps, educational resources, publications, activities and other related tools.
SMW is an independent project. Mentions, references and links to GeoGuessr, Google Street View and other external platforms do not imply official sponsorship, affiliation or endorsement, unless expressly stated.
1.3. Intellectual property of SMW
The Social Meta World name, its visual identity, design, structure, original software, graphic elements and own content are protected by applicable intellectual and industrial property legislation.
Content created by third parties retains its respective ownership, in accordance with the conditions in section 4.
PRIVACY POLICY
### 2.1. Data controller
The controller of personal data is Nebek Yamil Adur Salas, with the legal address indicated in section 1 and email socialmetaworld@gmail.com.
2.2. Personal data processed
Depending on the services used, SMW may process the following categories of data:
- Registration and identification data, such as name, email address, username and access credentials.
- Profile information, such as avatar, biography, country, language, links to external profiles and data that users choose to share.
- Participation information, such as metas, guides, publications, comments, ratings, evidence, reports, contribution history and reputation.
- Technical and security data, such as IP address, access logs, session identifiers and basic browser or device data.
- Data relating to subscriptions, transactions and credits, when paid services are activated.
- Queries sent to artificial intelligence tools, if these features are available and users choose to use them.
SMW will seek to request only the data necessary for each purpose.
Users must not publish sensitive personal data or private information about third parties without a valid legal basis.
2.3. Privacy of real identity
A real name, email address and other data provided in private fields will not be displayed publicly merely because a person registers.
Other members may view only public profile information, such as an alias, avatar, biography, publications, contributions, ranks or badges and other data identified as public.
Users should bear in mind that personal information they voluntarily include in published text, images, documents or links may be visible to third parties.
2.4. Purposes and legal bases
SMW may use personal data to:
- Create and maintain accounts, authenticate users and provide requested services: performance of the contractual relationship.
- Manage publications, contributions, ratings and community participation: provision of the service and, depending on the processing, legitimate interests.
- Prevent abuse, detect infringements, protect Platform security and manage reports: legitimate interests and compliance with legal obligations.
- Handle requests concerning privacy and users’ rights: compliance with legal obligations.
- Manage payments, subscriptions, invoicing and tax obligations: performance of a contract and legal compliance.
- Send optional commercial communications: consent, or another permitted legal basis where applicable.
- Use non-essential cookies or equivalent technologies: users’ consent where required.
When relying on legitimate interests, SMW must assess their necessity and proportionality against the rights of the people affected.
2.5. Data retention
Account data will be retained while the account remains active and afterwards only for the periods necessary for legal obligations, legitimate claims or duly justified security reasons.
Invoicing records will be retained for the applicable tax and accounting periods.
Community content may remain after an account is deleted when it can be disconnected from its author without enabling their identification and it is legitimate to retain the contributed knowledge.
Deleting an account does not necessarily entail deleting information that must be retained to comply with a legal obligation or to establish, exercise or defend legal claims.
2.6. Account deletion and anonymisation
Users may request account deletion by writing to socialmetaworld@gmail.com or through the tools provided in their profile, when available.
When an account is closed:
- Personal data that is no longer necessary will be deleted or anonymised.
- Community publications may be retained without identifiable attribution, where effective anonymisation is possible and a legal basis justifies the previous processing.
- Content that cannot reasonably be separated from personal data will be deleted or subjected to the measures required by applicable law.
- Information subject to legal obligations may be blocked or retained for the relevant period.
Anonymisation must be effective and reasonably prevent re-identification, rather than merely replacing a name with an identifier.
2.7. Recipients and providers
Data may be processed by technology providers necessary for hosting, authentication, storage, email, security, payments, maps, translation and artificial intelligence services.
These providers must offer the contractual and technical safeguards required by law.
Before the final launch, the identification of providers and, where applicable, categories of recipients, locations and international transfers must be completed.
Users’ personal data will not be sold to advertisers.
2.8. International transfers
If some technology services involve transfers of data outside the European Economic Area, SMW will apply mechanisms recognised by the GDPR, such as adequacy decisions or standard contractual clauses, together with any necessary supplementary safeguards.
Specific information will depend on the services ultimately contracted.
2.9. Rights of data subjects
Users may request, under the conditions laid down by applicable law:
- Access to their personal data.
- Rectification of inaccurate data.
- Erasure of data.
- Restriction of processing.
- Data portability where applicable.
- Objection to certain processing.
- Withdrawal of consent, without affecting previous lawful processing.
- Not to be subject to solely automated decisions with legal or similarly significant effects outside the cases permitted by law.
To exercise their rights, users may write to socialmetaworld@gmail.com. Additional information may be requested to verify identity where necessary.
Requests will be handled within the statutory time limits.
Users may also lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos): https://www.aepd.es/.
2.10. Security
SMW will apply technical and organisational measures proportionate to the risks, to protect data against unauthorised access, loss, alteration or disclosure.
However, no internet-connected service can guarantee absolute security.
2.11. Minors
Registration in SMW will be permitted from the age of 14, without prejudice to additional requirements applicable in the user’s country of residence and to the service used.
Children under 14 may not create accounts.
Additional protective measures and restrictions on certain features, particularly paid features, may apply to users under 18.
Minors must not share personal information that compromises their own or others’ safety.
TERMS AND CONDITIONS OF USE
### 3.1. Acceptance
General access to public content is subject to the legal conditions applicable to browsing.
Creating an account requires express acceptance of these terms through the mechanism provided during registration.
Acceptance of these terms does not replace specific consents that may be required for other processing.
3.2. Registration and accounts
Users undertake to provide truthful information in fields requiring real data and to keep data necessary for the operation of the service up to date.
Public aliases may differ from real names.
Each user is responsible for protecting their account credentials and reporting any suspicion of unauthorised access.
Impersonation and using accounts to evade sanctions, manipulate scores or conduct fraudulent activities are prohibited.
3.3. SMW services
The Platform may offer:
- Consultation, creation and classification of geographical metas.
- Publication and consultation of educational guides.
- A library of images, documents, videos, links and resources.
- Interactive maps and practice maps.
- Informational and learning articles.
- Educational tools and exercises.
- Rankings, badges, reputation and community contributions.
- Publications by creators and streamers.
- Tournaments, activities and masterclasses.
- Premium features and artificial intelligence tools.
The availability of each feature depends on its stage of development, technical conditions and, where applicable, the subscribed plan and permissions granted.
3.4. Acceptable use
Users must use SMW lawfully, respectfully and in a manner compatible with its educational and community purposes.
The following are not permitted:
- Publishing illegal, fraudulent, threatening or discriminatory content, or content that infringes third parties’ rights.
- Sharing protected materials without permission or another valid legal basis.
- Unlawfully publishing third parties’ personal data.
- Distributing malware, misleading links or content intended for fraud.
- Manipulating votes, statistics, reputation or classification systems.
- Using abusive automation or accessing systems and data without authorisation.
- Publishing spam or unauthorised advertising.
- Evading SMW restrictions or security measures.
3.5. Accuracy of published knowledge
Metas, guides, maps and other contributions are intended for informational and educational purposes.
SMW encourages community evaluation of their reliability, but does not guarantee that all content is accurate, up to date or applicable in every situation.
Reliability classifications, votes, badges and scores reflect community or editorial criteria rather than official certifications.
Users should cross-check information where necessary.
3.6. Service availability
SMW may carry out maintenance, technical improvements or functional changes.
Uninterrupted availability of services is not guaranteed, although efforts will be made to maintain their proper operation.
Interruptions or changes will not limit the statutory rights of consumers of paid services.
PUBLISHED CONTENT AND INTELLECTUAL PROPERTY
### 4.1. Authors’ responsibility
Each user is responsible for the materials they decide to publish or incorporate into SMW.
By submitting a publication, users declare that:
- They are the author, hold the necessary rights, or have permission or a legal basis permitting its use.
- They do not infringe intellectual property, privacy, image or other third-party rights.
- Contributed links are included legitimately and are not presented misleadingly.
- Photographs, documents and videos have the necessary permissions for use where required.
- Information is presented in good faith, distinguishing verified facts, observations and hypotheses.
Publishing a URL does not automatically grant rights over the linked content.
4.2. Ownership of contributions
Authors retain the rights that legitimately belong to them over their original contributions.
Publication on SMW does not transfer intellectual property ownership to the Platform’s owner.
4.3. Licence necessary to use content
By publishing original content, users grant SMW a non-exclusive, royalty-free, worldwide licence, limited to the rights they can lawfully grant, to store, reproduce, display, technically distribute, index, organise, adapt to the Platform’s format and translate their contributions to the extent necessary to provide SMW’s features.
This licence allows content to be displayed on meta pages, guides, search tools, related pages and other tools of the Platform, respecting authors’ rights.
The licence does not authorise SMW to sell users’ original content separately to third parties or exploit their works for purposes unrelated to the described services without the relevant permission.
Translations and adaptations must reasonably preserve the original meaning and applicable rights.
4.4. Retention of contributions after account deletion
Because SMW is collaborative and accumulates shared knowledge, contributions may remain part of the community library after an account is closed, provided there is a legal basis for retaining them and intellectual property and data protection rights are respected.
Where appropriate, public attribution will be removed and data associated with the author anonymised.
This provision does not limit the right to request content removal when there is a legal basis.
4.5. Third-party resources
Links to Street View, videos, maps, documents, external websites and other platforms are subject to their respective owners’ terms and rights.
SMW does not acquire rights over external materials merely by linking to them.
The conditions of APIs, mapping services and platforms used will be respected.
4.6. Notification of infringements
Anyone who believes content infringes their rights may notify socialmetaworld@gmail.com or use the reporting system provided.
The communication must identify the affected content, explain the grounds for the complaint and supply the information needed to assess it.
SMW will analyse notices and act in accordance with applicable law, and may remove or restrict content where appropriate.
COMMUNITY RULES AND MODERATION
### 5.1. Content review
SMW may use community procedures, human reviews and automated tools to detect content that may be inaccurate, duplicated, abusive or incompatible with these terms.
Automated intervention does not presume that content is illegal or remove the safeguards applicable to users.
5.2. Moderation measures
Depending on the nature and seriousness of the situation, SMW may take proportionate measures, such as:
- Requesting corrections or additional evidence.
- Marking content as awaiting verification.
- Correcting errors under editorial rules.
- Reducing publication visibility where there is a valid justification.
- Removing illegal content or content contrary to these terms.
- Temporarily suspending features or accounts.
- Cancelling accounts in serious or repeated cases, respecting applicable law.
Decisions must follow objective, proportionate and non-arbitrary criteria.
5.3. Reports and review
SMW will offer an accessible electronic channel for reporting allegedly illegal content.
Reports will be examined diligently and the decision communicated where legally required.
When restrictions are imposed on content or accounts, an explanation and relevant information on challenge or review options will be provided, in accordance with applicable law.
Users may request a review by writing to socialmetaworld@gmail.com, without prejudice to specific complaint mechanisms required where applicable.
5.4. Reputation and roles
SMW may assign badges, ranks, scores and recognition based on contributions.
Moderation and administration roles are granted by SMW authorisation, not automatically by reaching a score.
Tournament organisation and publication as a content creator may require specific permissions.
These mechanisms do not provide a contractual guarantee of retaining a rank or recognition.
MEMBERSHIPS, SUBSCRIPTIONS AND PAID SERVICES
### 6.1. Free and premium services
SMW may offer free access and paid subscription options providing different tools, features and usage limits.
The specific conditions of each plan, its benefits, restrictions, prices and included taxes will be displayed before contracting.
Publishing information about future features does not imply that they are already available.
6.2. Contracting and confirmation
Before paying, users can learn the essential characteristics of the service, its total price, billing frequency, duration and cancellation conditions.
Every contract must require an express action that clearly indicates an obligation to pay.
The contract will be confirmed on a durable medium, such as email, with the information legally required.
6.3. Subscriptions and renewal
Subscriptions may renew automatically when users are informed before contracting and accept this.
Users may request cancellation through mechanisms provided by SMW.
Unless more favourable conditions have been expressly announced, cancellation prevents future charges and maintains the subscribed benefits until the end of the period already paid for, without prejudice to statutory withdrawal, termination and refund rights.
6.4. Credits and artificial intelligence tools
Some plans may include usage credits for AI services and advanced tools.
Credits are internal consumption units and do not constitute electronic money, financial assets or transferable instruments.
Before subscribing or acquiring additional credits, users will be informed of the included benefits, consumption rules, any expiry, limitations and refund conditions.
Technical failures attributable to the service will be handled in accordance with statutory consumer rights and applicable commercial terms.
6.5. Right of withdrawal and refunds
Consumers may exercise their right of withdrawal within the applicable statutory period, generally 14 calendar days for distance contracts, except where statutory exceptions apply.
For services starting during the withdrawal period, the legal rules on express requests to start and, where applicable, a proportionate amount for services already provided will apply.
Loss of the right of withdrawal for certain digital content may occur only when all legal requirements are met, including the required consents and confirmations.
SMW will not impose a general, automatic waiver of the right of withdrawal merely for subscribing or accessing a premium feature.
Specific refund conditions will be provided before any payment transaction.
6.6. Minors and purchases
Access to free features from age 14 does not automatically authorise entering into paid contracts.
Contracts entered into by minors are subject to applicable contractual capacity and assistance or authorisation rules.
SMW may restrict paid services to adults or implement the necessary checks and authorisations.
6.7. Third-party features
Tournaments, masterclasses, activities or services offered by third parties must clearly identify their organiser and the corresponding specific conditions.
Where SMW acts solely as a promotion or linking platform, this will be disclosed transparently.
If SMW acts as seller, payment intermediary or direct provider, the relevant contractual responsibilities will be communicated before contracting.
COOKIE POLICY
### 7.1. What cookies are
Cookies and similar technologies allow information to be stored on or retrieved from the device used to visit a website.
7.2. Cookie categories
Depending on its technical configuration, SMW may use:
Technical or necessary cookies: enable essential features such as authentication, security, session maintenance and basic operation.
Preference cookies: may remember language, accessibility or personalisation options.
Analytics cookies: enable statistics about website visits and performance.
Advertising cookies: could be used in future to manage advertising, subject to information and consent requirements.
7.3. Consent
Non-essential cookies will be used only when there is a valid legal basis and the required consent has been obtained.
Users will have mechanisms to accept, reject and modify preferences for non-essential cookies, and refusal must not unjustifiably prevent access to basic services.
7.4. Specific information
Before services using non-essential cookies are activated, users will be informed of their purposes, providers, duration and possible third-party access.
The definitive list of cookies must correspond to the technologies actually used by SMW.
ARTIFICIAL INTELLIGENCE AND AUTOMATED TOOLS
### 8.1. Assisted features
SMW may incorporate artificial intelligence tools to help draft metas and guides, translate content, explain geographical knowledge, generate educational materials and prepare maps.
Results may contain errors, omissions or incorrect interpretations.
8.2. Users’ responsibility
Users must review and confirm AI-generated or suggested content before publishing it.
Using these tools does not exempt users from respecting copyright, community rules and publication conditions.
8.3. Information processing
Queries, files or content sent to AI services may be processed by technology providers under the privacy terms communicated to users.
Sensitive personal data or confidential third-party information must not be sent without a valid legal basis.
SMW will disclose the applicable providers, purposes and safeguards when these features become operational.
COMMUNICATIONS, CHANGES AND APPLICABLE LAW
### 9.1. Communications
SMW may send communications needed to maintain accounts, report security issues, respond to requests, confirm transactions and notify relevant changes.
Commercial communications will be sent only when there is a legal basis, respecting rights to object and withdraw consent.
9.2. Changes to the terms
SMW may update these terms to reflect legal, technical or functional changes.
When changes materially affect users’ rights, notice will be given with appropriate advance warning.
Changes may not be applied retroactively to deprive consumers of rights already acquired.
9.3. Applicable law
These conditions are interpreted under Spanish law and applicable European Union rules.
Choosing Spanish law does not deprive consumers of mandatory protection available under applicable international rules.
Disputes will be resolved by the competent bodies determined by applicable legislation, without imposing jurisdiction on consumers that infringes their rights.
9.4. Contact and complaints
